Terms of Service

1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you and Aether Practice Solutions Inc., doing business as InboxMD ("InboxMD," "we," "us," or "our"). By accessing or using the InboxMD service at inboxmd.ai (the "Service"), you agree to be bound by these Terms. If you do not agree, do not use the Service.

2. Service Description

InboxMD is an AI-powered Software-as-a-Service (SaaS) platform that assists physicians in drafting InBasket message responses. The Service uses artificial intelligence to generate draft replies based on patient messages and clinical context provided by the user.

3. Eligibility

The Service is available to licensed physicians with a valid National Provider Identifier (NPI). By creating an account, you represent and warrant that you hold an active, unrestricted medical license and a valid NPI.

4. Account Responsibilities

You are responsible for:

Maintaining the confidentiality of your login credentials.
Not sharing your account or API keys with any other person.
All activity that occurs under your account.
Notifying us immediately at support@inboxmd.ai if you suspect unauthorized access to your account.

5. Acceptable Use

You agree to use the Service only for its intended purpose: drafting medical InBasket message responses. You may not:

Use the Service for any purpose other than medical message drafting.
Attempt to reverse engineer, decompile, or extract the underlying AI models or algorithms.
Use automated scripts, bots, or scrapers to access the Service.
Transmit malicious code or attempt to interfere with the Service's operation.
Resell, sublicense, or redistribute the Service without written authorization.

6. PHI and Clinical Responsibility

InboxMD is a drafting tool, not a clinical decision-making system. You, the physician, are solely responsible for reviewing, editing, and approving all AI-generated drafts before sending them to patients. AI-generated content may contain errors, omissions, or inaccuracies.

You must exercise your independent professional judgment when using any draft produced by the Service. InboxMD does not replace clinical expertise and should not be relied upon as a sole source of medical information or advice.

7. AI Disclaimer

All drafts generated by InboxMD are AI-generated suggestions and do not constitute medical advice. The physician bears full responsibility for the clinical accuracy, completeness, and appropriateness of any message sent to a patient. Aether Practice Solutions Inc. makes no warranty regarding the accuracy of AI-generated content.

8. Billing and Subscription

Pricing: $35 per month or $299 per year.
Free trial: New accounts include a 14-day free trial. No credit card is required to start the trial.
Cancellation: You may cancel your subscription at any time from your account Settings. Cancellation takes effect at the end of the current billing period.
Refunds: Refunds are handled on a case-by-case basis. Contact support@inboxmd.ai for refund requests.

9. HIPAA Compliance

Aether Practice Solutions Inc. operates as a Business Associate under HIPAA. Upon subscription, we enter into a Business Associate Agreement (BAA) with you or your practice. The BAA governs our obligations with respect to any Protected Health Information (PHI) that is transmitted through the Service. A copy of the BAA is available for download in your account Settings.

10. Limitation of Liability

To the maximum extent permitted by applicable law, Aether Practice Solutions Inc. and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising out of or related to your use of the Service.

Our total aggregate liability for any claims arising from or related to the Service shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

11. Termination

Either party may terminate this agreement at any time. You may delete your account from your account Settings. We may suspend or terminate your access if you violate these Terms or engage in conduct that we reasonably believe is harmful to other users or to the Service.

Upon account deletion, all data associated with your account will be permanently removed from our systems, including your profile, de-identified messaging patterns, and usage logs.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Washington, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the state or federal courts located in the State of Washington.

13. Changes to These Terms

We may revise these Terms from time to time. If we make material changes, we will notify you by email or by posting a notice on our website at least 30 days before the changes take effect. Your continued use of the Service after the effective date constitutes acceptance of the revised Terms.
